The following constitutes a critical information summary setting forth key elements of your Agreement with Starlink.
If Starlink Service is currently unavailable in your area and you are signing up to the Starlink Terms of Service, then the following terms apply to you:
You agree to pay a one-time Pre-Order Payment of $129 CAD (plus taxes). The Pre-Order Payment grants you priority within your region for securing Starlink Services, if and when available.
The Pre-Order is fully refundable at any time prior to Starlink shipping your Kit. Placing a Pre-Order Payment does not guarantee the Starlink Kit and Services will become available to you. Starlink will apply your Pre-Order Payment to the amount due on the Starlink Kit if and when the Starlink Kit and Services become available to you.
When Services become available in your area, Starlink will notify you by email that we are preparing to ship your Kit. By signing up for the Services, you agree to pay (i) a one-time fee for the Starlink Kit to be charged at the time your Starlink Kit is shipped, and (ii) a monthly recurring service fee beginning on the earlier of (a) the date you activate the Starlink Kit or (b) 30 days after Starlink ships your Starlink Kit (the “Payment Due Date”). Starlink will automatically charge your approved payment method for the first month’s service fee on the Payment Due Date. The service fee for the second month and all subsequent months thereafter will be due on the monthly anniversary of the Payment Due Date. Pricing may vary based on your location and selected equipment. Enter your address at www.starlink.com and select your configuration to view the applicable one-time and monthly fees.
If Starlink Service is available in your area today and you are signing up to the Starlink Terms of Service, then the following terms apply to you:
You may only use the software on the Starlink Kit in accordance with the terms at Software License and Usage Terms. Starlink provides a limited warranty that it will use reasonable efforts to facilitate that the Starlink Kit, at the time of delivery, and the Services, as performed, substantially meet performance goals set forth in Starlink Specifications. You are entitled to certain remedies if you provide a valid claim based on our limited warranty within 12 months of receiving the Starlink Kit.
Starlink will collect, use and disclose your personal information in accordance with the Starlink Privacy Policy. You may only use the Services at your address for personal, family, household or residential use and in accordance with the Acceptable Use Policy. You may not use, or permit others to use, the Services in any way that violates any law or applicable regulation.
Starlink Fair Use Policy describes how Starlink’s manage our network traffic and allocate customer data based on your Service Plan.
You may terminate the Services at any time via the Customer Portal, in which case we will provide you with a refund of any fees you paid in advance for Services not yet rendered. You may also receive a full refund for the Starlink Kit if you return it undamaged within 30 days of receipt.
Please note the following disclaimers and limitations of our liability, and your indemnification obligation to us:
EXCEPT FOR OUR LIMITED WARRANTY, WE PROVIDE THE STARLINK KIT AND SERVICES “AS IS,” WITHOUT ANY EXPRESS WARRANTY, CONDITION OR REPRESENTATION.
WE WILL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR INDIRECT DAMAGES, LOSS OF GOODWILL OR BUSINESS PROFITS, LOST REVENUE, WORK STOPPAGE, LOSS OR CORRUPTION OF DATA, COMPUTER FAILURE, DATA SECURITY BREACH, MALFUNCTION OR ANY LOSSES OR DAMAGES RESULTING FROM THE KIT INSTALLATION, REPAIR, REMOVAL, OR OTHER ASSOCIATED SERVICES.
OUR LIABILITY UNDER THESE TERMS FOR ANY INDIVIDUAL CLAIM OR ALL CLAIMS IN THE AGGREGATE WILL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US UNDER THESE TERMS OVER THE SIX MONTHS PRECEDING THE CLAIM GIVING RISE TO THE LIABILITY.
YOU AGREE THAT YOUR USE OF THE SERVICES AND THE STARLINK KIT, AND SUCH USE BY ANYONE USING YOUR ACCOUNT, IS AT YOUR SOLE RISK.
You agree to compensate and hold harmless Starlink against all claims, liability, damages, costs, and expenses, including but not limited to reasonable attorneys’ fees, arising out of or related to these Terms, any and all uses of your account, and your use of the Service.
If you have any complaints about the Services, please contact Starlink’s customer service department by creating a service ticket through your Starlink account. If you have a complaint that Starlink has been unable to resolve to your satisfaction, you can contact the Commission for Complaints for Telecom-television Services (CCTS) using the contact details at the end of the Agreement.
The following clauses relating to dispute resolution and class proceedings shall not apply if and to the extent that you are located in any jurisdiction in which laws prohibit parties from entering into an agreement to exclusively arbitrate their disputes or to waive their right to bring a claim as part of a class proceeding within the context of a contract such as this Agreement:
IF WE AND THE CCTS ARE UNABLE TO RESOLVE YOUR COMPLAINT TO YOUR SATISFACTION, YOU AGREE TO RESOLVE ANY FURTHER DISPUTES BETWEEN YOU AND US VIA BINDING ARBITRATION BY A SINGLE ARBITRATOR ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION IN ACCORDANCE WITH ITS UNITED STATES COMMERCIAL ARBITRATION RULES; and
YOU AND STARLINK AGREE THAT NO DISPUTE OR CLAIM MAY BE BROUGHT OR MAINTAINED AS PART OF A CLASS ACTION OR CLASS ARBITRATION OR OTHER REPRESENTATIVE ACTION OR ARBITRATION.
